Term of Use

Welcome to DermOnDemand. These Terms of Use (“Terms”) govern your access to and use of DermOnDemand’s services (“Services”), including any information, forms, communications, and other materials made available through the platform. By accessing or using DermOnDemand, you agree to be bound by these Terms.

1. Medical Services

Medical care provided through DermOnDemand is rendered by Joel Kopelman, MD, FACS, and his affiliated medical practice, or by other appropriately licensed healthcare professionals affiliated with the practice. DermOnDemand serves as a telemedicine platform that facilitates communication, intake, scheduling, and the delivery of medical care.
Submission of medical questionnaires, photographs, forms, and payment does not guarantee acceptance as a patient, establishment of a physician-patient relationship, diagnosis, treatment, or the issuance of a prescription. A physician-patient relationship is established only after your case has been reviewed and accepted by a licensed healthcare provider.

2. Access to Services

Your access to and use of the Services are at your own risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. DermOnDemand reserves the right to modify, suspend, or discontinue any aspect of the Services at any time.

3. Eligibility

You represent that you are at least eighteen (18) years of age. DermOnDemand does not knowingly provide services to individuals under the age of 18 without appropriate parental or legal guardian involvement and consent.

4. Privacy

Any information you provide to DermOnDemand is subject to our Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

5. Use of the Services

You agree to provide accurate, truthful, and complete information and to use the Services only for lawful purposes.

6. Medical Disclaimer

Information available through DermOnDemand is intended for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
Medical recommendations and prescriptions are issued only after review by a licensed healthcare provider and when medically appropriate. No guarantee is made that a diagnosis, prescription, or treatment will be provided.

7. Response Time

DermOnDemand strives to review submissions and provide an initial medical plan, recommendation, or communication within 24 to 48 hours after all required information has been received.
Certain conditions and medications require additional physician communication before treatment can begin. Such communication will be initiated within the same 24 to 48 hour period.

8. Prescription Medications

DermOnDemand is responsible for providing a medical evaluation and treatment plan within 24 to 48 hours. Once a prescription is transmitted, DermOnDemand cannot guarantee:
  • Pharmacy processing times;
  • Medication availability;
  • Insurance approvals or prior authorization requirements;
  • Shipping times;
  • When medications will be ready for pickup.
These matters are outside the control of DermOnDemand and the treating medical practice.

9. Conditions Requiring Additional Physician Review

Certain conditions and treatments require additional physician communication before treatment may begin. These include, but are not limited to:
  • Isotretinoin (Accutane);
  • Biologic medications;
  • Complex dermatologic conditions;
  • Conditions requiring laboratory monitoring;
  • Cases requiring additional history or counseling.
Treatment may be delayed until a physician has spoken directly with the patient. Such communication will be initiated within the 24 to 48 hour review period.

10. Limitations of Treatment

DermOnDemand and its affiliated providers do not guarantee that every patient will be accepted for treatment or that every requested medication will be prescribed.
Not all medical conditions are appropriate for telemedicine. The appropriate medical recommendation may include:
  • No treatment or prescription;
  • Additional laboratory testing;
  • Obtaining medical records;
  • Referral to another physician or specialist;
  • Recommendation for an in-person evaluation;
  • Recommendation to seek care at an urgent care center;
  • Recommendation to seek emergency department evaluation.
The professional services provided include physician review, medical judgment, counseling, diagnosis, treatment recommendations, and referral guidance. Treatment itself is not guaranteed.

11. Fees and Refund Policy

Fees paid to DermOnDemand are for physician review, medical evaluation, professional medical judgment, counseling, and treatment recommendations.
Once payment has been submitted, fees are generally non-refundable because physician review and administrative processing begin immediately.
A refund may be requested only if DermOnDemand fails to provide any response, treatment plan, or communication within 48 hours after receiving all required information, excluding delays caused by incomplete patient submissions.
Refunds will not be issued because:
  • A requested medication is not prescribed;
  • Additional testing, photographs, or records are required;
  • Treatment is determined to be medically inappropriate;
  • A patient is determined not to be a candidate for telemedicine treatment;
  • Referral to another physician or specialist is recommended;
  • An in-person evaluation is advised;
  • Urgent care evaluation is recommended;
  • Emergency department evaluation is recommended;
  • No prescription is issued;
  • A physician determines that a higher level of care is necessary.
Recommendations to seek care from another physician, urgent care center, emergency department, or specialist constitute medical advice and fulfill the professional services being provided. No refund will be issued solely because treatment could not be rendered or because the medical recommendation was to seek care elsewhere.

12. Physician Licensure and Patient Matching Policy

DermOnDemand connects patients with licensed healthcare providers for medical consultations, diagnosis, treatment, prescription management, and follow-up care.

Patients are required to provide and verify their physical location before each encounter. Patients are only matched with providers who hold active and unrestricted licenses in the state where the patient is physically located.

If no affiliated provider is licensed in the patient’s state, treatment cannot be provided and referral options may be suggested.

DermOnDemand and its affiliated providers do not diagnose, treat, prescribe medications, or establish a physician-patient relationship with patients located in states where the treating provider is not licensed.

13. Emergency Disclaimer

DermOnDemand is not intended for medical emergencies.

If you are experiencing chest pain, shortness of breath, severe allergic reactions, signs of stroke, severe infections, suicidal thoughts, rapidly worsening symptoms, or any other medical emergency, call 911 or seek immediate medical attention.

Do not rely on DermOnDemand for emergency care.

14. Changes to Services

DermOnDemand reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without notice.

15. Changes to Terms

DermOnDemand may revise these Terms from time to time. Continued use of the Services constitutes acceptance of any revised Terms.
